SISTRI: PROROGA DELLE SANZIONI AL 01/01/2015

Venerdì 28 Febbraio 2014 è stato approvato il cosiddetto “Decreto Milleproroghe”.

ll decreto va a modificare l’art. 11 del decreto-legge 31 agosto 101, convertito con modificazioni dalla legge 30 ottobre 2013, n. 125 introducendo un’unica novità rispetto al quadro previgente:

Posticipa al 31 dicembre 2014 il termine della fase sperimentale nella quale sono sospese le sanzioni inerenti al mancato o non corretto utilizzo del Sistri.

Restano quindi confermate le seguenti date:

3 marzo 2014 – Avvio della fase sperimentale per i produttori iniziali di rifiuti pericolosi, nonchè per i comuni e le imprese di trasporto dei rifiuti urbani del territorio della regione Campania;

Fino al 31 dicembre 2014 sono obbligatori, a pena di sanzione, gli adempimenti cartacei (costituiti da formulari e registri carico/scarico). Le sanzioni relative al Sistri non si applicano.

Si segnala inoltre che è in via di emanazione il cosiddetto “Decreto semplificazioni” nel quale saranno introdotte delle semplificazioni per rendere meno gravoso e meno complesso il Sistri.

Si tratta di un provvedimento importante perchè, probabilmente, andrà a ridefinire la platea dei soggetti obbligati al Sistri escludendone dall’obbligo gli enti e le imprese produttori iniziali di rifiuti speciali pericolosi fino a 10 dipendenti; l’eliminazione delle chiavette Usb per accedere al sistema; la possibilità di compilare le schede indistintamente da parte di tutti i soggetti della filiera, ed altre semplificazione che verranno valutate.

Quanto al contributo Sistri per l’annualità 2014, non esistono, ad oggi, disposizioni di legge che ne prevedano la sospensione o la proroga del versamento, il cui saldo è previsto per il 30 aprile 2014.
