Slitteranno di un altro anno le sanzioni del Sistri (sistema di tracciabilità dei rifiuti), previste a partire dal primo gennaio 2015, questo quanto previsto da un emendamento presentato alla Legge di Stabilità, che conferma inoltre che durante questo periodo trovano applicazione solamente le sanzioni relativi agli obblighi pre-Sistri (MUD, registri di carico e scarico, formulario di identificazione dei rifiuti) lasciando dunque impunite le mancanze relative agli adempimenti portati dal Sistema di controllo della tracciabilità dei rifiuti.
L’emendamento ha ottenuto il via libera dalla Camera dei deputati e attende ora il via libera anche da parte del Senato per la conferma ufficiale del nuovo rinvio sulle sanzioni.
La presentazione dell’emendamento è stata accolta con favore dalle aziende, che sin dalla prima presentazione del Sistri hanno chiesto, piú volte, al governo di sostituire questo sistema di controllo, che ha sempre creato difficoltà e problemi, con un altro meccanismo di smaltimento di rifiuti pericolosi.
Il ministro dell’Ambiente, Gian Luca Galletti ha così dichiarato sul Sistri durante un convengo: “il sistema telematico di tracciamento delle merci pericolose è obsoleto” e ne ha annunciato la sostituzione “con uno piú moderno dal punto di vista tecnologico, un sistema di tracciabilità totalmente nuovo, che sarà condiviso con le associazioni di categoria”. Ed inoltre: “L’attuale sistema è del 2004, ai tempi era tutto diverso, non c’erano neanche i tablet. Dal primo gennaio del 2016 avremo un nuovo sistema magari anche copiando dall’Europa”.
Il Sistri, quindi, lascerà il posto ad un sistema piú moderno ed entro il 30 giugno 2015 il Ministero bandirà una gara europea per affidare la concessione del servizio di tracciamento informatico dei rifiuti nel rispetto del Dlgs 163/06 (contratti pubblici per lavori, servizi e forniture) dopo l’uscita di scena della Selex che ha comunicato al ministero dell’Ambiente di non voler proseguire nella gestione del sistema di tracciabilità dei rifiuti.
Nel comunicato, la Selex Service Management, puntava il dito contro una serie di comportamenti delle istituzioni (oneri aggiuntivi sostenuti a fronte di modifiche normative, richieste del Ministero, mancati pagamenti di fatture emesse e numerose proroghe all’entrata in vigore del sistema con la conseguente riduzione degli utenti e dei relativi contributi che hanno comportato un enorme squilibrio contrattuale)

È utile ricordare che l’articolo 14 della Legge Competitività (decreto-legge 24 giugno 2014, n. 91, convertito con modificazioni con la legge 11 agosto 2014, n. 116), in vigore dal 21 agosto scorso, prevede l’obbligo per il Ministero dell’Ambiente di provvedere ad ulteriori semplificazioni del Sistri, in relazione all’applicazione dell’interoperabilità e alla sostituzione dei dispositivi token usb.

The repeated delays around SISTRI seem to create almost as much confusion as the system itself. While many companies will probably welcome another postponement, it also makes long-term planning harder. La proroga delle sanzioni Sistri conferma quanto questo sistema abbia creato difficoltà operative concrete alle aziende fin dall’inizio. La prospettiva di un meccanismo di tracciabilità rifiuti completamente rinnovato e condiviso con le categorie produttive sembra finalmente la direzione giusta.
È interessante notare quanto dibattito abbia suscitato questo argomento tra governo e imprese. Le preoccupazioni sollevate dalle aziende sono fondate, soprattutto per quanto riguarda i costi e la facilità d’uso. Un sistema di tracciabilità dei rifiuti più chiaro ed efficiente porterebbe benefici sia alla regolamentazione che alla tutela dell’ambiente nel lungo periodo.
